Carver ZBA Grants Bisbee Drive ADU Variance, Conditions Permit on Eversource Response

Carver's Zoning Board of Appeals granted an accessory dwelling unit variance Thursday but conditioned the permit on the applicant first getting a written response from Eversource Energy about a disputed guy wire and a misplaced stockade fence. The board voted unanimously to approve a nine-foot east-side setback variance for Mr. Spinetto of 10 Bisbee Drive, where the existing setback of 21.6 feet falls 8.6 feet short of the required 30 feet; members cited the Eversource easement as constraining the shape of the lot under MGL Chapter 40A.

The condition states that "the permit to build will not be granted until the petitioner receives a response from Eversource regarding the issues with the guy wire and the moving of the fence," with documentation to be filed with the planning department. In a second case, the board continued a special permit hearing for Darren Holliman of 243 Meadow Street — seeking a two-story, 1,710-square-foot detached garage where 700 square feet is allowed as of right — after discovering that construction plans were missing from the application file; the case was rescheduled to August 4 at 6:30 p.m. The board also announced that a Superior Court judge dismissed a challenge to its July 23, 2024 decision in the Save the Pine Barrens case involving alleged sand removal at 46 Federal Road.
