Halifax Zoning Board denies dormant Lake Street application and tables new Carver Street variance to April. The board voted unanimously Monday to deny ZBA-25-12 at 102 Lake Street after the applicant failed to respond or communicate with the board over an extended period, with a building inspector urging the board to force a resolution. The new matter, ZBA-26-1, involves a homeowner at 37 Carver Street seeking a variance to build a roughly 2,556-square-foot addition — including a garage, new kitchen, and two bedrooms — that would sit 22.2 feet from the required 30-foot side setback, an encroachment of approximately 7.8 feet.
Board members expressed support for the project's design but warned the applicant that the variance standard requires a hardship rooted in the lot's physical characteristics, not owner choices, telling him "you've got to have a hardship." The case was continued to April 13, with the board urging the applicant to return with a revised footprint that reduces or eliminates the need for a variance.
