Pembroke Planning Board closes a subdivision hearing and gets a stark warning on new state zoning law. Chair Andrew Wandell's board unanimously voted to close the public hearing on David West's one-lot West Mill Lane subdivision off Lily's Way, pending conditions at the October 5 meeting, and separately approved a minor site-plan modification and a 2028 extension for a long-delayed commercial project at 345 Oak Street. The bulk of the meeting, though, went to Town Counsel Amy Questel of KP Law, who walked the board through zoning changes buried in the state's fiscal 2027 budget bill, warning that new variance standards favoring housing production mean "if an applicant comes in for a variance and the end result is going to be housing, I think they're going to be very hard-pressed to not grant it." Questel said the changes, which also let additions to nonconforming structures proceed as-of-right and extend zoning freezes to 24 months, arrived with no input from the Massachusetts Municipal Association or municipal lawyers.

The board moved to form a subcommittee, including Questel's firm, to bring Pembroke's bylaws into conformance by spring town meeting.
